Estate Planning in a nutshell

Estate planning is all about preserving, protecting and passing on your wealth down generations or to loved ones. It’s about maintaining control of your assets and ensuring that your wishes are carried out.

How can Fortis Law help?

Fortis put their clients in a position to be able to make an informed decision about what they want to do with their assets. They give you tailored advice specific to your circumstances and their professional team are fully trained and qualified to support you. They are then here to help you by creating these important legal documents and ensuring they are signed correctly so that they can be used when they are needed.

What services do they provide?

Will Writing

A Will provides certainty. It ensures that your assets pass to the people you choose and that the right people (executors and trustees) manage this when you have gone. It allows you to appoint guardians for minor children, make gifts to charity, and to protect assets through the use of Will trusts.

Lasting Powers of Attorney

A Lasting Power of Attorney (LPA for short) is a document which, once registered, allows your attorneys (people you choose) to manage your affairs should you become unable to.

There are two types of LPA:

- Health and Welfare

- Property and Financial Affairs

Trusts

A trust is a way of managing assets (money or your house etc.) and they can be set up for a number of reasons. Reasons include where you want to protect assets for family and friends, where people cannot manage money because they are too young or vulnerable and you’d like someone to manage it for them, or where someone becomes incapacitated.

There are different types of trusts and they are taxed differently.

- Probate and Estate Administration

Probate and Estate Administration is the legal process of proving a Will. This means that it is accepted as the last Will and Testament by the probate court. From here the process of drawing in somebody’s assets, paying off their liabilities and administering the estate in accordance with their Will can begin. Before drawing in assets, and dependent on the size of the estate, the executors, must apply for the grant of probate.

Funeral Planning

An increasingly popular way to combat these rising costs is to pay for your funeral now, fixing the costs (less disbursements) at today's prices and with Fortis Law, we can help you with a pre-paid funeral plan.

This gives you the ability to arrange your funeral now removing the hassle for your loved ones.

Will and Document Storage

Making the decision to create important legal documents like your Will or Lasting Power of Attorney is a wise move. It’s equally as important to ensure that these documents are stored safely so that they can be found and used when they are needed.
